Body Worn Video Disclosure Actual Cost
Public Hearing on the proposal to include new fee for records disclosure for body worn video. The Lynnwood Police Department has instituted body worn cameras which capture video and audio. RCW 42.56.070 permits public agencies to charge actual costs for preparing records for disclosure. This state code also requires us to demonstrate how the actual costs were determined and provide notice and public hearing prior to adoption of the fee.
RCW 42.56.240 (14) provides for the exemption of some of the audio and video records to the extent nondisclosure is essential for the protection of any person’s right to privacy. In order to protect the exempt records, the department will need to pixilate, distort, or remove the image or audio record, using trained staff members to apply they redactions.
A public hearing is required for this action and is scheduled for March 28th, with adoption of the ordinance requested for April 11th.
Changing council rules for virtual attendance
Council will discuss and/or vote on main motion “to amend the council rules to limit remote attendance by council members to 3 times per year” and the amendment “excluding executive sessions.”
Updates to Lynnwood Municipal Code Titles 3 and 5 related to business licensing
The purpose of this ordinance is to amend LMC 3.104.050 and Chapter 5.06 LMC to eliminate the Occupancy Fees in the amount of $1 per occupancy currently charged to businesses serving alcohol and Penalty Fees on late license renewals; and to amend Chapter 5.04 LMC to provide clarification on business license exemptions, no fee registrations. and enforcement of businesses operating without a valid license.
